Terms and Conditions

In the following conditions of contract "the photographer/videographer(s)" shall mean Pauline Dieudonne, trading as Love and Lace Media or any photographer/videographer(s) appointed by Pauline Dieudonne. These terms and conditions relate to wedding photography or videography bookings.

 

"The client(s)" shall be those whose name(s) appear on the contract. If the client(s) arranges for a third party to meet the costs of this contract, the contract remains with the client(s). The due performance of the contract is subject to the conditions below. These cannot be varied in any way by the client(s) unless such conditions are expressly agreed by the photographer/videographer(s) in writing by email.

Governing Law

Any contract made between the photographer/videographer(s) and the client(s) shall in all respects be governed by and construed in accordance with English Law and the parties hereto submit to the jurisdiction of the English courts.

 

Copyright

The Copyright Designs and Patents Acts assign the copyright of the images to the photographer/videographer(s). It is therefore contrary to the Acts, and illegal, to copy, or allow to be copied, by any means photographic, by computer, or the internet or otherwise, by any person or machine, other than by the photographer/videographer(s). The images taken by Love & Lace Media are for personal use by the Client(s) and their friends and relatives. Selling, publication or any commercial use of the photographs/film(s) is not allowed without prior written permission from Pauline Dieudonne.

 

Cancellation

If the client(s) wishes to cancel the booking after the 14-day cooling-off period, the booking fee is nonrefundable. If the client(s) cancel their booking with love and Lace Media within 1 month of their wedding day and full payment has been made, a refund of your full payment will only be made available should Love and Lace Media manage to rebook the date.

 

On the day

a) The photographer/videographer(s) shall be granted an artistic license in relation to the poses and the locations used. The photographer/videographer(s) judgment regarding the location, poses, creative direction and the number of photographs/videos taken shall be deemed correct.

b) Photographs/videos taken during the course of the event will be at the discretion of the photographer/videographer(s), although every effort will be made to comply with the client(s) requirements. A good faith effort will be made to capture all requested images/videos but due to the rapid pace and unpredictable nature of event photography/videography, it is impossible to guarantee that all specific requested photographs/videos will be captured due to factors beyond the photographer/videographer(s) control e.g. weather, venue restrictions, light availability and scheduling complications due to lateness and willingness of individuals.

c) For a booking involving a church ceremony or at certain venues, the photographer/videographer(s) movements are sometimes restricted by the official in charge. The area from which the photographer/videographer(s) is able to cover the ceremony may not be the photographer/videographer(s) choice and the photographer/videographer(s) cannot accept responsibility for any obstructed view should this be the case. The use of artificial lighting may be restricted or prohibited. Some churches add on additional fees to record the audio from the ceremony, this is the client(s) responsibility to check with the appropriate official and cover these costs should they be necessary.

d) The client(s) is responsible for acquiring all legal permits and necessary permission for all locations on which Love and Lace Media will be performing their photography/videography services.

e) Coverage may be cancelled without warning at the discretion of the photographer/videographer(s) if the photographer/videographer(s) feels threatened in any way or has reason to believe that equipment may be damaged.

f) Any directions issued by the photographer/videographer(s) to the client(s), their guests or employees during the event are deemed to be at said persons own risk. The photographer(s)/videographer(s) cannot be held responsible for any personal accidents during the event. Love and Lace Media will be covered with appropriate Public Liability Insurance for all events.

g) In the spirit of cheerful cooperation, the client(s) agree to give the photographer(s)/videographer(s) precedence over any guests with digital cameras of their own in order for us to be able to capture the photographs/footage required. Love and Lace Media will not be held responsible for a guest stepping in front of the camera during any of the shots captured.

h) The client(s) agrees to organise a supplier meal with their venue for each of the photographer/videographer(s) present on their wedding day. Please note the meal should be ready for the same time that the wedding party will be eating their own wedding breakfast. The photographer/videographer(s) reserve the right to take a 1 hour break during this time.

 

Force Majeure

a) The due performance of the contract is subject to alteration or cancellation by the photographer/videographer(s) owing to any cause beyond their reasonable control.

b) If the photographer is too ill or becomes injured and cannot for any reason supply the agreed wedding services, then liability is limited to a refund of all payments received. Love and Lace Media will make every effort to find a replacement photographer/videographer for you to book. However, it may prove difficult to find a skilled replacement photographer/videographer at short notice at the same price agreed in this contract.

c) Although all equipment is checked regularly and reasonable steps are taken to ensure back-up equipment is available, there is the unlikely possibility that images may be lost, stolen or destroyed for reasons beyond the photographer/videographer(s) control. Liability is limited to the return of fees paid or part thereof according to the percentage of images supplied. Neither party shall be liable for indirect or consequential loss.

 

Liability for Digital Files and Products

a) The final photographs/film(s) shall be kept for ONE year from the wedding date at one site.

b) Client(s) are responsible for making back-ups of their media once they are delivered. Should digital media be lost, damaged, or destroyed the photographer/videographer(s) holds no responsibility, however, will try to replace them but only at a cost to the client(s).

c) No refunds will be made on products ordered once they are customised and ordered to the client(s) request.

 

After the day

a) All images will be adjusted with basic corrections such as exposure and contrast including creative adjustments suiting Love and Lace Media's style. The photographer/videographer’s judgement regarding these corrections and the number of images put forward to the client(s) shall be deemed correct. Love and Lace Media is not liable to deliver every image taken at the event, the determination of the number of images delivered is left to the discretion of the photographer/videographer.

b) RAW photos or footage is not available to the client(s) under any circumstances.

c) Due to a variety of lighting conditions, some colours may alter throughout a set of photographs/footage. The photographer/videographer is not liable for any changes in colour from scene to scene due to the nature of the venue beyond the photographer/videographer(s) control.

d) The Photographs/film(s) will be edited and shared with the client(s) via an online delivery method within 8 weeks from the contracted wedding day. The USB will only be sent out by post after confirmation that your gallery has been viewed and no changes need to be made.

 

Privacy

Pauline Dieudonne/Love and Lace Media may store your data on a private internal database. This data will not be made available to outside companies or individuals. Should you wish to have your data removed from the database, please advise in writing and retain your confirmation. You can read more about or privacy policy here.

 

Albums

a) Once your order is placed and confirmed, you will have up to 6 months to choose the images for your album. If you do not choose them after this time, we will select and design the album without your prior consent.

b) Once we have received your image choices we will design and send you a digital proof within 4 weeks.

c) You have up to 3 revisions to make any changes you wish to the digital preview.

d) Once your order has been approved, you will be sent an invoice to pay for your album within 2 weeks.

e) Once you have approved your order and it has been paid for, NO AMENDMENTS can be made.

f) No refunds are available for albums or any customised order. All of the products are quality checked personally by myself however if you do find an issue with your product, I will raise it with the supplier and get a replacement ASAP.

g) Only photos that were taken by Love and Lace Media will be included in the album, this means no guest photos will be included.

 

Display

The client(s) hereby allow(s) the photographer/videographer(s) to display any photograph/footage covered by this contract and to generally promote the business in advertising, brochures, magazine articles, websites, sample albums and prints, venue, and other vendor samples, and other such material, providing that the images/media used are used lawfully and without damage to the client(s). The Client(s) may retract their consent at any given time under GDPR regulation by contacting Love and Lace Media in writing at: hello@loveandlacemedia.co.uk.

Complaints

In the unlikely event of the Client(s) wanting to raise a complaint regarding the photography/videography services supplied by Love and Lace Media, this should be done in writing, within 28 days of first becoming aware of the matter to be complained of and in any event within 28 days of receipt of their deliverables.
